At Direct from Factory, Inc. (“DFF”), we respect our customers’ privacy. DFF operates worldwide under Verlas. This privacy policy (“Policy”) applies to all DFF activities, including, but not limited to our brands’ websites, and all other websites, mobile sites, services, applications, platforms and tools where this Policy appears or is linked (collectively, our “Website”). This Policy is to inform you about how we collect, use, share, and protect personal information. By providing information to us (by any means, whether in correspondence, via our Website or otherwise) you consent to our use of the information you provide in accordance with this Policy. Any reference to our Website includes its e-mail, text, live chat, and other electronic messages. If you do not agree with this Policy or our practices, you may not use our Website or related services.

This Policy may change from time to time and is incorporated into our Website Terms of Use. We will notify you when changes are made to the Policy. Your continued use of our Website constitutes your acceptance of those changes. We encourage you to review this Policy periodically.

1. Information We Collect

We collect personal information about you in various ways, such as when you provide it at on our Websites or affiliated websites, and social media channels, at our events, through your participation in surveys, via text messages or on the telephone. The types of personal information we may collect include:

We also may collect information about the location of the mobile device or tablet used to access the Website (“Location Data”). We will inform you if a specific Website, or service collects precise Location Data. When you connect with social media though the Website, you may link with social media platforms and social media plug-ins (e.g., the Facebook “Like” button, “Share to Twitter” button) (collectively, “Social Media”). When accessing services through a Facebook or other Social Media accounts, we may (depending on the applicable user privacy settings) automatically have access to information provided to or through the Social Media platform. We may collect and use this information for the purposes described in this Policy or at the time the information is collected.

Information collected directly by the third party providers of the features is subject to the privacy policies or notices of these providers. We are not responsible for these providers’ information and privacy practices.

Information we collect will only be used as described in this Policy. If you choose not to provide certain information, we may not be able to provide you with requested products, services or information.

2. How We Use the Information We Collect

4. Information We Share

We do not disclose personal information we collect about you, except as described in this Policy. We may share personal information with Service Providers who perform services on our behalf. The term “Service Provider” shall have the meaning given to it under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.198) or other applicable data protection laws. These Service Provider are permitted to use or disclose the information only as necessary to perform services on our behalf or comply with legal requirements. Examples of these Service Provider include entities that process credit card payments, manage and reduce our credit risk, verify information, fulfill orders, and provide web hosting, analytics and marketing services. We may also share information or data in a form that cannot be used to uniquely identify or contact an individual person (“non-personal information”). We may collect, use, transfer, and disclose this non-personal information for any purposes. Non-personal information that we collect may include information regarding your activities on the Website, which may be aggregated and used to help us provide more useful information to our customers and to understand which parts of the Website are of most interest.

5. How We Protect Personal Information

We enforce commercially reasonable security measures online and in our physical facilities to protect against the loss, misuse, disclosure, or alteration of personal information provided to us. While we strive to safeguard your personal information, we cannot guarantee the security of any information you disclose or transmit to us.

If you receive an e-mail that looks like it is from us asking you for your personal information, do not respond. We will never request your password, username, credit card information, or other personal information through e-mail.

DFF provides reasonable physical, electronic, and procedural safeguards to protect consumers’ personal data. For example, DFF limits access to this information to authorized employees, service providers, and contractors who need access to perform the activities described in this Policy. Additionally, we have taken measures to make shopping on the Website a safe and enjoyable experience for our valued customers. We use Hypertext Transfer Protocol Secure (HTTPS), Secure Shell (SSH), and IP Security (IPSec) encryption technology to encrypt your personal credit information, including your credit card number, before it travels over the Internet.

6. Choice/Opt-Out

We offer you certain choices in connection with the personal information we collect about you, such as how we use the information and how we communicate with you. To update your preferences, ask us to remove you from our mailing lists, exercise your rights regarding your personal information, or submit a request, please contact us. You can also unsubscribe from receiving our emails by following the “Unsubscribe” link provided in our emails. We will honor your request to remove you from our mailing lists, but there may be a delay between submission of such request and actual removal from our mailing lists, as these lists are generated well in advance of our actual mailings. Opting out of communications does not affect our communication with you via telephone or email regarding your orders or other sales or service transactions.

You may request access to the personal information we maintain about you or request that we correct, amend, delete or block the information by contacting us. You may withdraw any consent you previously provided to us or object at any time on legitimate grounds to the processing of your personal information, and we will apply your preferences going forward.

7. Text Messaging Services

When you sign up for one of our text messaging programs, you are expressly consenting to receive text messages on your cell phone or other mobile device about our products, services, and/or programs which may be sent by automated means. Text messages will only be sent to the mobile phone number used to opt into the applicable text message program. Details on how many messages you should expect to receive are provided at the time of enrollment. In some instances, you may have the opportunity to reply to a message, which may result in additional response messages. Your consent to enrollment in any text message program is not a condition of purchase. For information about a text message program you may text HELP to the applicable short code.

Message and data rates may apply. We do not charge a fee for our text message programs and assume no responsibility for charges by your carrier that you may incur when you sign up to receive text messages from us. You may opt out of a text message program at any time by texting STOP to the applicable short code, or as otherwise stated in the specific terms and conditions for the applicable text message program. You may receive a final confirmation message to confirm that you will no longer receive text messages from the applicable text message program unless you opt back into such program. Some of our text messaging services have additional terms and conditions that will apply in addition to the description above.

8. Children’s Privacy

We are committed to protecting the privacy of children. The Website is not directed to children and we do not knowingly collect any personal information from children. If you are under 13 do not use our site or provide any information about yourself including, without limitation, your name, address, email address or any screen name or user name you may use. If a child under the age of 13 has provided us with personal information online, we ask that a parent or guardian please contact us. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. 9. Do Not Track Policy

Some browsers have a “do not track” feature that lets you tell websites that you do not want your online activities tracked. At this time, the Websites do not respond to web browser “do not track” requests or similar signals that users may employ.

By providing information on or through a Website you are consenting to the collection, use and disclosure of such personal information as described in this Policy. You may withdraw your consent at any time by following the procedure described in the Choice/Opt-Out section above.

11. Links to Third Party Sites and Services

This Website may contain links to third party websites operated by individuals or companies unrelated to us. 12. Access and Retention

If you have a Website account, you can log in to view and update your account information. You may also contact us with requests for information, questions or concerns, to request edits to your personal information, or to have your personal information removed from our database. We keep your personal information for as long as we think is necessary or advisable, and we reserve the right to retain it to the full extent not prohibited by law.

13. Notice of Financial Incentive

We may offer you certain benefits in connection with the disclosure of personal information and data associated with your account. For example, we may offer you the opportunity to be eligible for certain perks and benefits such as rewards, exclusive offers, and discounts. All benefits are free of charge.

When you participate in these perks and benefits, we will collect and keep the personal information you provide, or that you’ve previously provided. To enhance your experience with and reward you, and to provide you with tailored benefits, we may also collect and use the following categories of personal information listed in connection with your accounts, including personal information we’ve previously collected about you:

The benefits to accountholders are reasonably related to our good-faith estimate of the value provided to us by their personal information. The value of personal information to us varies by individual and is related to the value of the rewards and discounts provided to accountholders, minus the costs of providing those benefits.

You may withdraw from participation from any rewards program at any time by following the instructions provided upon enrollment.

Your Privacy Rights

California, Colorado, Connecticut, Virginia, Utah, and other states have passed consumer data protection laws that give consumers rights and control over their personal data. Depending on your state of residence, you may have certain rights related to the personal data we have collected from you, which may or may not be granted based on the circumstances, but only in compliance with applicable law. You must provide enough information that allows us to verify your identity. Only you or your authorized agent may make requests regarding your personal information. An authorized agent must have documentation that they are authorized to act on your behalf. We will fulfill or reject your request within the amount of time required by law.

Some states grant residents the right to appeal any decision we have made related to your rights request. California Shine the Light Law: California Civil Code Section 1798.83 permits individual California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes during the preceding calendar year. Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to privacy@verlas.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

14. Your General Data Protection Regulation (GDPR) Privacy Rights

If you are a resident of the European Economic Area, the United Kingdom, or Switzlerland, You may have certain rights related to the personal data we have collected from you, which may or may not be granted based on the circumstances, but only in compliance with applicable law. These rights may include the following:

  • The right to remove consent, where you have provided it, at any time.
  • The right to ask us to confirm if we are processing your personal data.
  • The right to ask for access to your personal data.
  • The right to ask to correct your personal data if it’s wrong.
  • The right to ask us to delete your personal data.
  • The right to be forgotten and you can ask that our systems stop using your personal data.
  • The right to ask us to restrict how we use your personal data.
  • The right to ask us to help you move your personal data to other companies. You have a right to ask that we provide your personal data in an easily readable format to another company.
  • The right to ask us to stop using your personal data.
  • The right to lodge a complaint to the relevant supervisory authority.

We generally process personal data of those residing in the EU on the legal basis of our legitimate interests in performing the function or service you requested. Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing. Where we process your personal data on the basis of consent, we will clearly obtain your opt-in consent. Where given, you may withdraw your consent at any time by contacting us. A withdrawal of consent will not affect the validity of our use of your Personal Information up until the point you have withdrawn your consent.

If we process your information based on our legitimate interests as explained in this Privacy Policy, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your data for direct marketing purposes, you can always object using the unsubscribe link in such communications or changing your account settings.

15. Locations; Data Transfers

DFF is based in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative, at your sole risk, and you are responsible for compliance with all applicable laws.

When you access this Website, you understand and acknowledge that we may transfer, process, and store information about you in the United States and other countries, both within and outside of the European Economic Area.
